Arizona’s business community sent the following statement to the state Legislature regarding the Drought Contingency Plan

On behalf of the organizations listed below, we support the Joint Resolution authorizing the ADWR on behalf of the State of Arizona to sign the interstate DCP Agreement, and we support the consensus legislation that will facilitate the agreement. We urge their passage by the Arizona Legislature by the January 31st deadline.

We used the following guiding principles to evaluate the Arizona Drought Contingency Plan in order to protect and sustain Arizona’s maximum Colorado River water supply:

  • Promote a vibrant and growing economy, while maintaining good stewardship of our water, including vigilant defense of Arizona’s rights in the Colorado River
  • Protect Arizona’s Colorado River allotment and Arizona’s ability to effectively manage the allotment, including maintaining the reliability of those supplies for current and future use in Arizona
  • Promote water conservation and similar efforts that will protect the water elevation of Lake Mead
  • Provide regulatory certainty that is based on clear statutory authority
  • Support local jurisdictions and industry in their reasonable and cost-effective efforts to address critical infrastructure needs in response to pending shortages on the Colorado River and allow for continued growth of the economy
  • Support the Central Arizona Groundwater Replenishment District’s (CAGRD) ability to meet current and future replenishment obligations
  • Support the creation and use of long-term storage credits to allow flexible management of water resources necessary to achieve the goals stated above
  • Encourage the US Department of Agriculture and the US Department of the Interior to assist with DCP implementation

If by January 31st the parties to the DCP agreements in the Lower Basin have not finished their work to complete the DCP, the Department of Interior will publish a notice in the Federal Register. In that notice, the Department will ask all seven states for their specific recommendations for prompt action by the Department to reduce the risk the basin is facing.  The states have 30 days for those submissions. The Department will take those submissions and decide on a course of action before the August determination on 2020 operations.  Allowing the federal government to prescribe DCP is not what is best for our state, our economy, and our water security – it takes control from Arizonans, and lays the groundwork for litigation leading to uncertainty and potential long-term harm.
